Vallejo, California, has specific regulations for Accessory Dwelling Units (ADUs) to ensure they align with local standards. Here are the key details:

Types of ADUs:

  • Detached ADUs Separate structures from the main dwelling.
  • Attached ADUs Physically connected to the primary residence.
  • Conversion ADUs Adapt existing spaces within the primary dwelling or accessory structures.
  • Junior ADUs (JADUs) A type of conversion ADU, typically limited to 500 sq. ft.

Development Standards:

Setbacks:

  • Side and Rear Setbacks Minimum of 4 feet for detached and attached ADUs.
  • Conversion ADUs and JADUs No setback required if the existing structure's footprint is maintained.

Size Limits:

  • Detached ADUs Up to 1,000 sq. ft.
  • Attached ADUs Cannot exceed 50% of the primary dwelling's floor area.
  • JADUs Maximum of 500 sq. ft.

Height Restrictions:

  • Detached ADUs Generally limited to 16 feet in height.

Parking Requirements:

  • General Rule One parking space per ADU is required.
  • Exemptions- Parking requirements may be waived if
    • The ADU is located within half a mile of public transit.
    • The ADU is part of the existing primary residence or an existing accessory structure.
    • On-street parking permits are not required in the area.
    • There is a car share vehicle located within one block of the ADU.

Approval Process:

  • ADU applications are subject to ministerial approval, meaning they are reviewed against objective standards without discretionary judgment.
  • The city aims to issue approvals within 60 days of receiving a complete application.

Occupancy and Rental Regulations:

Owner Occupancy:

  • For Junior Accessory Dwelling Units (JADUs), the property owner must reside in either the primary dwelling or the JADU.
  • There is no owner-occupancy requirement for standard ADUs.
  • Rental Terms ADUs cannot be rented for periods shorter than 30 days, effectively prohibiting short-term rentals like those offered through platforms such as Airbnb.

Design and Architectural Standards:

  • Exterior Design
    • The design, color, materials, and texture of the ADU must match the primary dwelling to ensure architectural consistency.
  • Entrances
    • For attached ADUs and JADUs, a separate exterior entrance is required.
    • JADUs may share a bathroom with the primary residence.

Fire Safety and Utilities:

  • Fire Sprinklers ADUs are not required to have fire sprinklers if they are not required for the primary residence.
  • Utility Connections
    • Separate utility connections and meters for water, sewer, and electricity are not mandatory for ADUs.
    • Utility capacity fees may apply, especially for newly constructed units.

Impact Fees:

  • Fee Exemptions ADUs under 750 square feet are exempt from impact fees.
